AGREEMENT BETWEEN THE USER AND CLICKFERRY
This document sets out the General Conditions that bind Clickferry and the User in the processes of selling ferry tickets through this website, subject to their unmodified acceptance for the legal relationship between the parties to take full effect.
The User declares that they are over 18 years of age and/or have the legal capacity required to be bound by this agreement and to use this website in accordance with the General Conditions set out here, which they fully understand and accept.
The purchase of ferry tickets through this website is strictly forbidden where the purchaser qualifies as a professional/company and the ticket is intended for resale to a final consumer. Therefore, it is an essential requirement that the purchaser qualifies as a consumer, within the terms provided for in Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws.
ACQUISITION OF PRODUCTS AND SERVICES THROUGH THE WEBSITE
The sale to the User of tourist products and services through the Website is carried out by Clickferry, a travel agency holding the permits and licences required to carry out its activity.
In particular, the User of the Website accepts that they will use the Website only for themselves and that the products or services acquired through the Website will be for their own use or consumption or for the persons on whose behalf they are legally authorised to act. The User will not resell products or services acquired through the Website to other persons.
Any bookings or purchases of products or services made by the User from the providers or shipping companies that the User chooses shall be subject to the specific terms and conditions established by such providers or shipping companies for each case.
The User agrees to accept and comply with the terms and conditions of purchase established by any provider or company with which they choose to contract, including, without limitation, the payment of any amounts due and compliance with any rules and restrictions regarding the availability of fares, products or services. If there are special rules or restrictions affecting certain fares, products or services selected by the User, such special rules or restrictions will be disclosed to the User prior to the completion of the sale process.
The preparation and updating of information about offers, products or services, prices, routes, distances, characteristics and any other relevant data and information about the products and services offered through the Website is the responsibility of the respective product or service providers or companies. Clickferry is not responsible for the maintenance, review, supervision or updating, nor is it in a position to verify the accuracy, currency, precision or completeness of such information.
The product or service providers and the shipping companies, each within the scope of their respective obligations, will be responsible to the User for complying with the obligations arising from current regulations and from the terms and conditions of sale of each of the products and services or package travel contracted, with Clickferry assuming no obligation or liability whatsoever in respect of products or services it does not directly provide.
SALES PROCESS
Clickferry has a simple and fast ticket search and purchase system:
Select your port of departure and port of destination, the date of your trip and the passenger details.
All available options will appear on the screen: all schedules, shipping companies and prices.
Select your preferred outbound and return option, if applicable.
The purchase process will be completed once you fill in the payment details and confirm.
The User will receive an email with the details and confirmation of the ticket purchase.

Nevertheless, for informational purposes, the following generic information useful to the passenger is provided. In the event of a discrepancy between the passenger information provided by Clickferry and that provided by the corresponding Company, the information provided by the latter shall prevail.
My ticket
The Clickferry ticket is personal and non-transferable.
The passenger's personal details, as well as the vehicle details (make, model, licence plate, etc.) appearing on the ticket must necessarily match the passenger's personal details and the vehicle to be boarded; otherwise the company may deny boarding.
The ticket holder is covered by the Compulsory Passenger Insurance, and the company is not liable for damages caused by passenger negligence or by failure to comply with the indicated safety rules.
You must keep your ticket in order to submit any type of claim or complaint.
Check-in
Boarding passes can only be issued once, so it is recommended that they be issued a few days before departure. The User can issue boarding passes through the check-in section of this website or directly at the ticket office on the day of departure. In this regard, the User should be aware that some shipping companies do not allow online issuance of boarding passes, so the User is advised to check how the ticket should be presented directly in the Terms of Use of each Shipping Company.
Likewise, on routes across the Strait, boarding passes cannot be obtained on the website. From the port of Tarifa, boarding passes are obtained at the window of the Shipping Company the User will be travelling with, always bringing a printed transport voucher. From the port of Algeciras, access to the boarding area is granted with only the transport voucher if travelling with Trasmediterránea and Balearia. With any other company, you must obtain them at its window.
In the event of loss of the ticket, the passenger must contact the Shipping Company from which it was purchased. Clickferry assumes no liability for this loss.
Boarding
It is important that the User respects each Shipping Company's advance boarding times to ensure correct boarding.
Only the driver of the vehicle and, where applicable, minors travelling in their care, may board together with it; the remaining passengers must do so through the passenger accesses. On the other hand, the driver and other passengers may disembark on board the vehicle, except when the ship's crew does not deem it advisable.
Vehicles must always board with a driver. Trailers must always board and travel with the vehicle that tows them.
Documents required to travel
The passenger must always have the documents required by current law: DNI, passport or NIE. Documents must be originals and in force. Please note that the driver's licence is not valid for travel, but is mandatory for passengers carrying a vehicle.
Documents to be presented for discounted tickets:
Residents
All adult passengers must present the Certificate of Residence and a valid DNI to be able to apply this discount.
If the shipping company is integrated with the Ministry of Public Works' SARA telematic system, this allows verification of whether, as an EU resident in the Balearic Islands, Ceuta or Melilla, you meet the requirements to obtain the residence discount.
If the check is positive, you can carry out online check-in and only need to show at boarding an original, valid identification document: DNI (Spanish citizens, except for minors under 14) or NIE/Passport (foreign EU citizens). Resident children under one year of age do not need to present the residence certificate.
If the check is negative, you must obtain your boarding pass at the ticket office by presenting an original, valid residence certificate if you are Spanish; and if you are a foreigner who is a member of the European Union, you must also present the Union Citizen Registration Certificate to be entitled to the discount.
In addition, you must present an original, valid identification document: DNI (Spanish citizens, except for minors under 14) or DNI of your country / Passport (foreign citizens).
Large Family
To obtain the discount corresponding to a large family, it is essential to present these two documents:
Original, valid Large Family Title (issued by a Spanish Administration), or individual card for each passenger.
Photocopies of the pages of the Large Family Title showing the title category, the passenger's name, validity and expiry date (all information must be legible).
Luggage
The User must consult the terms and conditions of each Shipping Company regarding luggage. The company is not responsible for jewellery, valuables, money or other items of value belonging to passengers which have not previously been entrusted to the Captain of the ship for safekeeping. It is forbidden to carry on board goods of illicit trade and dangerous merchandise. Luggage transport conditions may vary depending on the company; please check the general transport conditions of each of them.
Cancellation or modification of booking
It is important that the User checks, prior to purchasing the ticket, the cancellation or modification policy of the shipping company with which the ticket is to be purchased. Cancellation or modification of the booking can be carried out provided the fare conditions allow it. In addition, the cancellation or postponement by the passenger of bookings and tickets, issued for a specific date, is subject to the general transport conditions of each Shipping Company. If the User requests cancellation of the ticket, the companies may charge a percentage of the ticket amount, which will vary depending on how far in advance the cancellation is communicated, with that percentage being able to reach 100% of the ticket amount. In any case, the User shall pay Clickferry the management fees as well as any cancellation fees, if applicable. If, based on the fare purchased, a full or partial refund of the price applies, the refund will be made within 14 calendar days from the date on which the decision to cancel the contract was communicated, using for the refund the same means of payment used by the consumer for the initial transaction. In any case, Clickferry will manage the processing based on each Company's cancellation policy and applicable fare. If the ticket fare allows modifications (changes of date, name, destination, vehicle, etc.), a modification fee will be charged, the amount of which varies according to the value of the ticket. If the ticket fare increases when changes are made to your booking, the User will have to pay the fare difference, as well as the cost of the change established in each Shipping Company's general conditions. In the event of cancellation by the shipping company due to weather or operational reasons, extras contracted will not be refunded.
Modification fees:
€10 for tickets below €100
€20 for tickets between €100 and €500
€30 for tickets above €500
Cancellation cover
This cover will entitle you to a refund of the ticket amount if, for force majeure reasons set out in the cover conditions, you are unable to travel. The cover must be formalised during the online contracting process.
Minors and pregnant women
Minors must travel with an adult companion and must provide a photocopy of the DNI, Family Book or valid passport, as well as presenting the originals, for trips within Spanish territory. For international trips, it is mandatory that the minor travels with a valid DNI or passport. If the minor's companion is not their father, mother or guardian, they must provide a specific authorisation signed by the father, mother or guardian along with a photocopy of that person's DNI. Pregnant women may travel, but the shipping company may require a medical certificate authorising them to travel from the 28th week of pregnancy onwards.
Passengers with reduced mobility and disabilities
Passengers with reduced mobility must inform us at the time of booking and, if possible, must travel with a companion who can provide assistance during the trip. Both ground and on-board staff will provide attention at all times to ensure the trip runs smoothly. At the time of boarding, depending on the ship and the line, it may take place before or after the rest of the passengers. In the latter case, passengers with reduced mobility and their companions may wait in the passenger lounge until staff indicate that they can board. Once on board, staff will indicate the most suitable location for the journey.
Pets
Pets must travel in the fitted cages provided on all ships. The cages are located on deck, in the garage or at other points on the ship, in properly ventilated and suitable places, protected from rain and cold. The passenger must carry the animal certificates required by the health authorities. The animals' care during their stay on board will be the responsibility of their owners. Pets have an additional cost depending on the route.
Cancellations or delays in departures and/or arrivals
If your ferry suffers any type of delay in departure and/or arrival, or any cancellation, you may file a claim with the shipping company. Clickferry is not responsible for these situations, and it is the shipping company whose vessel has suffered the delay or cancellation that must respond to your claim.
PRICES
The User will be able to see the total amount to be paid before confirming the payment. The price specifies all applicable concepts, including taxes and, where applicable, the service fee (2.4%) with a minimum amount of €2.99 for booking processing.
However, depending on the conditions applicable at any given time, certain advantages or discounts may be offered on the service fee, which will be duly communicated to the User during the contracting process, before completion of the purchase.
In any case, the User will be able to see the total amount to be paid before confirming the payment.
PAYMENT METHODS
Clickferry makes different payment methods available to the User for contracting the services offered on the Website. The payment methods available at any given time can be viewed during the purchase process, before the booking is completed. The User warrants that they are the holder of the payment method used or that they are legitimately authorised to use it. Validation of the transaction will in any case be subject to authorisation by the issuing entity of the corresponding payment method and, where applicable, to the authentication or verification systems established by that entity or by the payment service provider.
Credit/debit card
The User may pay by credit or debit card accepted by the platform, including, where applicable, American Express cards, provided this payment method appears as available at the time of purchase. Payment will be made through a secure payment gateway operated by a duly authorised external payment services provider. During the payment process, the User must enter the card details in the secure environment provided for this purpose and, where applicable, follow the authentication procedure required by their bank. As a general rule, Clickferry neither stores nor has access to the bank card data used by the User to make the payment. This data is processed directly by the entity providing the payment gateway, in accordance with its own terms and conditions and with the applicable regulations on payment services and security.
Apple Pay
The User may make payment via Apple Pay, provided this payment method is enabled in the purchase process and the device used is compatible with that system. To use this payment method, the User must have an Apple device with Apple Pay configured, as well as a valid card previously linked to their digital wallet. During the payment process, the User must authorise the transaction through the authentication mechanisms established by Apple. Authorisation of the transaction takes place in the secure environment managed by Apple and the card's issuing entity, so Clickferry neither stores nor has access to the full card data or to the authentication information used by the User. Payment via Apple Pay is subject to the security, authentication and fraud prevention protocols applied by Apple and by the card issuer, which may require additional verifications or express confirmations before definitive authorisation.
Google Pay
The User may make payment via Google Pay, provided this payment method is enabled in the purchase process and the device used is compatible with that system. To use this payment method, the User must have a Google account with Google Pay configured, as well as a valid card previously linked to their digital wallet. During the payment process, the User must authorise the transaction through the authentication mechanisms established by Google. Authorisation of the transaction takes place in the secure environment managed by Google and the card's issuing entity, so Clickferry neither stores nor has access to the full card data or to the authentication information used by the User. Payment via Google Pay is subject to the security, authentication and fraud prevention protocols applied by Google and by the card issuer, which may require additional verifications or express confirmations before definitive authorisation.
PayPal
The User may make payment via PayPal, provided this payment method is enabled in the purchase process. To use this payment method, the User will be redirected to PayPal's secure environment, where they can identify themselves with their account and authorise the transaction in accordance with the conditions established by that provider. The processing of access, payment or authentication data linked to the PayPal account will be carried out directly by PayPal, with Clickferry having no access to the User's credentials or to the full financial information associated with that account. Payment via PayPal is subject to the security, authentication and fraud prevention protocols applied by the provider itself, which may require additional verifications, validation of the User's identity or express confirmation of the transaction before definitive authorisation.
Payment with PayPal will carry an additional cost of 3.4% of the transaction cost + €0.35.
Bizum
The User may make payment via Bizum. To make the payment, the User must have an active Bizum service linked to a bank account and a mobile phone number, as well as access to the app or online banking of the financial institution that has joined that system. During the purchase process, the User must enter the phone number linked to Bizum and follow the validation instructions provided by their bank or service provider. Authorisation of the transaction takes place in the secure environment of the bank or of the system enabled by Bizum, so Clickferry does not store the User's banking credentials or access the authentication information used to confirm the payment. Payment via Bizum may require entry of a specific key, validation from the banking app, confirmation through a security code or any other authentication mechanism established by the User's entity, all in order to ensure the security of the transaction and prevent unauthorised uses. The formalisation of the booking will be conditional upon correct authorisation of the payment by the corresponding bank. If the transaction is rejected, cannot be validated or is not completed correctly, the booking will not be considered to have taken place.
Bank transfer / Account deposit
Pay by bank transfer or account deposit. Choosing this payment method does not guarantee the booking until the receipt of the purchase amount has been confirmed. Once the deposit/transfer has been verified, subject to availability, the purchase process will be carried out. If the departure is imminent (up to 2 business days from the purchase process), it is mandatory to make an account deposit or transfer from the same entity (La Caixa or BBVA). Your booking will always be processed by the customer service department within our business hours. The User may access their invoice in electronic format in the "My invoice" section or request their invoice in paper format at the email address atencionclientes@clickferry.com.
Scalapay
Where, at the time of payment, the User is offered the possibility to finance the purchase amount, such financing will be provided by a third-party entity unrelated to Clickferry. Consequently, the conditions applicable to such financing (including, among others, costs, commissions, interest and deadlines) will be those established in the General Contracting Conditions of the entity providing the service, whose acceptance will be exclusively the responsibility of the User.
The user may access their invoice in electronic format in the "My invoice" section or request their invoice in paper format at the email address atencionclientes@clickferry.com.
REMEMBER CREDIT/DEBIT CARD NUMBER
If the User expressly requests the option to remember their credit/debit card details for subsequent purchases on our website, we inform you below about the terms and conditions of this process:
To guarantee the confidentiality, privacy and security of the information you provide to us, we indicate that your credit card details will be stored securely with the financial institution (BBVA) with which we have contracted this service. Clickferry will only keep the code returned by the financial institution associated with the card, the expiry date and the last 4 digits of that card.
For subsequent purchases, the User may choose the option of paying directly with one of their previously stored cards; in which case, once the card is selected by the User, the payment will be made automatically without having to re-enter the card details.
If you wish to delete the credit/debit card data stored by the financial institution, you may do so in the "My Clickferry" section of this website.
PROTECTION OF PERSONAL DATA
In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), as well as in compliance with Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights, you are informed below about the following points related to the processing of personal data through this website.

Likewise, we inform you that the retention of the information does not imply any international transfer of data.
Purpose of data processing and nature of the data collected
The information collected in the online contracting procedure is processed for the purpose of managing the sale and after-sales of the product and/or service requested by the User, as well as managing the Cancellation Cover, if contracted. The data collected is of an identifying nature (first name, surname, address, telephone, email) as well as data related to the purchase process, payment method and invoicing. If the User requests the application of the Cancellation Cover, Clickferry will process the documentation and data provided by them to evidence the alleged cause (e.g. medical, employment, judicial or administrative information), which may include, where applicable, special categories of data such as health data, only insofar as they are strictly necessary for processing and resolving the request.
Accuracy of the information provided
All information provided by the Client must be truthful and accurate. To this end, the Client warrants the authenticity of all data provided when completing the corresponding forms. Likewise, it shall be the Client's responsibility to keep all information provided to Clickferry up to date, so that it reflects, at all times, their actual situation. In any event, the Client will be solely responsible for any false or inaccurate statements they may make, and for any damage caused to Clickferry or to third parties by the information provided.
Legal basis for data processing
The legal basis for processing data related to the online purchase process is the performance of the contractual relationship between the parties. The legal basis for processing data in relation to sending commercial communications to clients about products or services related to those initially contracted is Clickferry's legitimate interest in keeping you informed about offers and promotions that may be of interest to you, all on the basis of article 21.2 of the Information Society Services Act (LSSICE). Clickferry has enabled a checkbox in the purchase process so you can object to the processing of your data for the aforementioned purposes, and in each commercial communication we send you, we will give you the option to unsubscribe by means of a quick, simple and free procedure.
Data retention
Data relating to the online purchase process will be retained for the period during which the relationship between the parties is maintained. Subsequently, they will be duly blocked during the statutory limitation period for legal actions, and after that period they will be deleted.
Personal data and documentation provided for processing the Cancellation Cover (when contracted by the User) will be retained for the time strictly necessary to analyse and resolve the request. Subsequently, they will be duly blocked during the statutory limitation period for legal actions, and after that period they will be deleted.
Exercising rights
The User has the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. The User may request the limitation of the processing of their data, in which case Clickferry will only keep it for the exercise or defence of claims. In certain circumstances and for reasons related to their particular situation, the User may object to the processing of their data. In this case, Clickferry will stop processing the data, except for legitimate reasons, or for the exercise or defence of possible claims. Finally, we inform you of your right to portability provided for in the GDPR, so that your data may be provided to the data controller indicated by the User. To exercise these rights, the User may send an email to rgpd@clickferry.com or a letter addressed to the following address: Plaza Costa del Sol, 10 L.155-159 CC Entreplazas, 29620 Torremolinos.
In cases where you consider that, during the processing of data by Clickferry, your data protection rights have been infringed, particularly when you have not obtained satisfaction in the exercise of your rights, the User may lodge a complaint with the competent Supervisory Authority for Data Protection.
Information security
Clickferry uses technologies appropriate to the current state of the art to protect your personal data and information. Our website is hosted on secure servers protected against the most common types of attacks. However, we remind you that no technology is invulnerable and that you must therefore put in place the means within your reach to maintain the level of security of your data. In particular, we recommend that during the user registration process you use strong passwords, with at least 8 characters alternating numbers, letters, upper-case, lower-case and special characters. We also recommend that you change your password periodically (at least once a year) and that if you suspect that a third party may know it, you change it immediately.
Clickferry has adopted the technical and organisational measures that guarantee the security of personal data and prevent its alteration, loss, processing or unauthorised access, taking into account the state of the technology, the nature of the stored data and the risks to which they are exposed.
Third-party data
Should you provide us with personal data of third parties, you must obtain their prior consent, informing them under the terms established in this document. Clickferry is not responsible for non-compliance with this requirement, nor for any incidents arising from the lack of accuracy or truthfulness of the information provided about third parties.
When necessary for the formalisation of the contracting process, we will communicate the strictly necessary data to the providers of the products and services, for the sole purpose of fulfilling the purpose of the contract.
In cases where, after having been informed, the User does not object to receiving offers, discounts and promotions, we will use their contact data to send them informative communications by email about products and/or services related to our activity.
Likewise, if the User expressly indicates so, we will store the identifying data they provide so they do not have to enter it again in future ticket purchases on this website.
The User is responsible for treating confidentially and properly safeguarding any passwords provided to them by Clickferry, preventing access by unauthorised third parties. The User is solely responsible for the economic consequences arising from any use of this Website made using the User's password on the Clickferry Website, as well as from the use of the User's passwords by third parties.
The User also declares that all information supplied by them to access this Website and in the course of its use is true, complete and accurate, and undertakes to keep it up to date.
